Common Defects

Your vehicle may be suffering from an issue that impacts its use, safety, or value. If it is not repairable after a reasonable number of attempts, that can be considered a good reason to file a lemon law claim. However, some issues tend to come up more frequently than others. Some of the most common problems we see include:
  • Transmission failure or slippage. Transmission failures that can’t be resolved are some of the most serious problems you can have with a vehicle. Issues that indicate transmission problems can include loss of power, rough shifting, and stalling. Eventually, these issues lead to a complete system failure.
  • Electrical system malfunctions. Today’s cars feature extensive computer systems, so electrical issues can impact just about any aspect of your vehicle’s use. Common signs of electrical problems can include warning lights that won’t shut off, battery drain, and problems with infotainment systems, lights, and windows.
  • Engine stalling or failure. If you notice that your engine is stalling out or failing to maintain power, that could be a sign of a serious underlying issue, and your car may be a lemon.
  • Brake system issues. Properly functioning brakes are a must to keep you safe while you’re behind the wheel. If your brakes aren’t working as they should, even after multiple repair attempts, this safety-related issue can qualify for a vehicle replacement or reimbursement. Look for grinding and squeaking noises, problems with your ABS system, inconsistent brake performance, and premature wear on brake pads.
  • Steering or suspension problems. Steering and alignment problems need to be taken seriously because they can impact your ability to maintain control over your vehicle. Common warning signs can include pulling to one side, a rough ride, uneven tire wear, or clunking noises while driving.
  • Persistent fluid leaks. Whether your vehicle is leaking oil, coolant, or transmission fluid, a persistent leak that can’t be resolved after a reasonable number of repair attempts is considered a good reason to file a lemon law claim.
  • Airbag or seat belt defects. Safety system defects must be taken seriously. They must be resolved within two repair attempts, or your car qualifies as a lemon.
  • Climate control failures. Air conditioning and heating are critical to maintaining your comfort while you’re in your car, especially in extreme weather. Persistent climate control problems are cause for declaring your vehicle a lemon under California lemon laws.
  • EV software or electrical issues. If you drive an EV, software or electrical defects can get in the way of your ability to use your car.
