Many consumers are familiar with the basics of California’s lemon law as it applies to new vehicles that are proven defective. However, some consumers wonder whether the lemon law also applies to demo vehicles, which are often purchased by consumers from dealerships. If you are a California consumer, it is important to understand the relationship between the California Lemon Law and demo vehicles in case you ever find yourself with a demo lemon.

What Is a Demo Vehicle?

A demo vehicle is a car that salesmen at a dealership may use to demonstrate the features of a particular make and model. To qualify as a demo vehicle, the car must never have been sold to a consumer. Because demo vehicles are used to show prospective buyers how a car functions, dealership employees often drive them enough to put a few miles on them. For this reason, demo vehicles can be attractive to prospective buyers because they are often significantly discounted.

What Is California’s Lemon Law?

California is a very populous state with tens of millions of drivers, and the automotive sales market is robust and healthy. In 2023, more than 1.78 million new cars were sold to California consumers. Most new cars function well, but a fraction of them exhibit serious mechanical issues.

California’s Song-Beverly Consumer Warranty Act, informally known as the lemon law, is a piece of legislation that exists to protect consumers from financial loss as a result of manufacturer defects in new vehicles.

Under this law, if a vehicle has a defect that cannot be adequately repaired after a reasonable number of attempts and affects the car’s functionality, safety, or overall value, the consumer can receive a refund or a replacement from the manufacturer. To be eligible for coverage under the lemon law, the defect must be covered under the manufacturer warranty.

Does the Lemon Law Apply to Demo Vehicles?

Demo vehicles are considered new vehicles for the purpose of California’s lemon law as long as they are sold under the manufacturer’s warranty, which is the case for the vast majority of demo cars. If you have purchased a demo vehicle from a dealership, and you now suspect that it is a lemon, you can pursue a replacement or a refund by contacting the manufacturer’s customer service department and formally requesting one.
